Final VCAT decision on amended development plan and planning permits

Following on from Council’s decision on 27 August 2025, the Victorian Civil and Administrative Tribunal (VCAT) has made a final decision on applications for an amended development plan (Ref. DP/2021/1/A) and the planning permits (Ref. PLN/2024/365 and PLN/2024/378).

A breakdown of the final decision:

DP/2021/1/A (VCAT number P325/2025)

Application P325/2025 – Development plan amended

  1. In application P325/2025, pursuant to section 51 of the Victorian Civil and Administrative Tribunal Act 1998 (Vic) the deemed refusal of Macedon Ranges Shire Council to amend the approved Gisborne Area 1 Development Plan Version D dated 16 June 2023, is set aside.
  2. In substitution, the approved Gisborne Area 1 Development Plan, Version D dated 16 June 2023 is amended in accordance with the Gisborne Area 1 Development Plan Version K, dated 10 February 2026.

PLN/2024/365 (VCAT number P323/2023)

Application P323/2023 – Permit granted

  1. In application P323/2025 the decision of the responsible authority is set aside.
  2. In planning permit application PLN/2024/365 a permit is granted and directed to be issued for the land at Lot B PS916545Y, 89 Ross Watt Road, Gisborne in accordance with the endorsed plans and the conditions set out in Appendix A. The permit allows:

  2. In planning permit application PLN/2024/378 a permit is granted and directed to be issued for the land at Lot B PS916545Y, 89 Ross Watt Road, Gisborne in accordance with the endorsed plans and the conditions set out in Appendix B. The permit allows:
