Amendment C154macr is a combined planning scheme amendment and planning permit application PLN/2022/198.

This Amendment being undertaken by Council at the request of the landowners. All affected property owners and occupiers will be notified by mail prior to the exhibition date.

About the amendment

The Amendment seeks to rezone some of the last remaining parcels of agricultural land within the Malmsbury township boundary from the Farming Zone (FZ) to the Neighbourhood Residential Zone – schedule 13 (NRZ13), and remove the heritage overlay (HO148) from the site. Currently the site holds minimal agricultural value. The sites shape, size and close proximity to existing residential development, limits agricultural activities or primary production that can occur on the land.

The rezoning acts to facilitate a modest residential subdivision on the eastern edge of Malmsbury township.

About the permit application

In combination with the amendment, a planning permit application seeks approval to subdivide the land into nine lots ranging in size from 2,000 to 2,182 square metres in accordance with NRZ13.

The application of the NRZ13 will ensure that any future development of the site will reflect the current character of the area and featuring larger lots, significant landscaping and generous street setbacks. To achieve this, NRZ13 will include minimum subdivision area, minimum street setbacks and maximum site-coverage specifications. These measures will act to limit how much area of a lot a dwelling can occupy (site coverage), ensure lots are a minimum of 2,000 square metres (minimum subdivision area) and limit how close a dwelling can be built from a street (street setback).

Make a Submission

Community feedback is invited from Monday 26 February 2024 to 5pm on Monday 1 April 2024.

Anyone can make a submission. However, submissions are usually made by people who may be affected by a proposed Planning Scheme amendment (either as the owner or occupier of land which is to be the subject of changed planning scheme provisions) or who may be affected by changes on other land, such as neighbouring residents or business owners.

  • The amendment number (e.g. Amendment C154macr).
  • The name of the person making the submission with preferred contact details (and if you represent a group).
  • The address of the affected property (if applicable).
  • Clearly identify whether you support or oppose any part of the proposal and your reasons for this.
  • Any specific changes you would suggest we consider.

Submissions must be made in writing and lodged before the advertised closing date.

You can lodge your submission to Council a number of ways:

Submissions to an amendment become public documents and are to be made available for viewing during the amendment process. Submissions received will be redacted with all personal/identifiable details removed.

All submissions will be put before Council and considered at a Planning Delegated Committee meeting.
